How Long You Been Practising The Art: We're supposed to practice?
|
The owner of Pubticks told me that he removed "Vision" "...as a courtesy". He made no mention of you.
Lee Asher asked him if he would ALSO extend the courtesy to him and remove "Twisted". He declined. So, my concern with the business practices of PubTricks stands. I do understand, and SUPPORT them in, their being an original avenue for marketing of effects by people with no history or fame in the magic community. I understand that it is unreasonable to expect a businessman to take on the duty of researching each and every effect he markets for their rightful creator(s). What I do find repellent is the attitude: "Unless you provide me with equivalent or better material, go stuff yourself". This puts an unreasonable burden on the rightful creator, who may in fact NOT want to sell through the company. Also, the claim that he can sell whatever he wants unless (as one of the items listed states) he can be shown raw footage of the material has been previously copyrighted... well, if Slydini's Knotted Silks had been performed with white silks, and I came around and taped a version with red silks, and wore a different set of clothes than Slydini, then I would not be apparently be violating any "raw footage" claim. This seems ridiculous. I continue to avoid any dealings with PubTricks, and recommend to others that they consider carefully from whom they buy effects. Buy " The Asher Twist" directly from Lee Asher, and avoid the inferior, apparent rip-off, available elsewhere. As for your claims of innocence: The effect was published at Kranzomagic first. He pulled it when HE was notified by the effect creator. Nathan told me he let you know that was why he was removing it from his site. So you figured it was a GOOD IDEA to try and sell it elsewhere??? Did that really make sense to you? Did you think it would go un-noticed? [EDIT--I just read your post on your Vision thread. OK. I can believe you forgot that you had previously given another business the rights to publish. Good that they didn't announce the effect the same day...they would each have had good reason to be upset with you!] In your rush to publish, you seem to have left out the part where you research for "prior art". Putting out requests here and at other forums for "Hey, help me do my homework for sandwich and torn and restored effects!" is a respectable first step, but it is ONLY a first step. Use your computer and google away, follow up links, check out name variations. As I posted today on another thread: Better to take legit "hero" credit for Finding and Crediting material, than have assigned "loser" status for Plagiarism. Perhaps you can get some wisdom and guidance from other members here. Consider sending a PM to magicbulb. He is a legitimate creator of some powerful effects, and is marketed in multiple places. He also knows his history of magic, which helps in knowing if one has come up with something new, or has just re-created the wheel. I DO wish you the best of success in creating and selling NEW effects! pax maximus pinky |
